Privacy Policy
This Privacy Policy describes how Mark Studios LLC ("Mark Studios," "we," "us," "our") may collect, use, share, and otherwise process information in connection with markstudios.com, our content, our communications, and our services (collectively, the "Services"). By using the Services you consent to the practices described below.
Information we may collect
- Information you provide. This may include your name, email address, phone number, social handles, company, message contents, project briefs, footage, files, payment details, and any other information you choose to submit through forms, email, calls, or in the course of an engagement.
- Information collected automatically. When you access the Services we and our service providers may collect technical and usage information including IP address, device and browser identifiers, operating system, referring/exit pages, pages viewed, links clicked, time on page, approximate location derived from IP, and similar telemetry.
- Cookies and similar technologies. We and third parties acting on our behalf may use cookies, pixels, tags, web beacons, local storage, software development kits (SDKs), session replay tools, and other similar technologies for purposes including site functionality, authentication, analytics, performance measurement, personalization, marketing, advertising (including interest-based or cross-context behavioral advertising), attribution, and fraud prevention. You can manage many of these technologies through your browser settings or applicable opt-out mechanisms.
- Information from third parties. We may receive information about you from analytics providers, advertising partners, social media platforms, identity-verification providers, payment processors, lead-generation partners, public sources, and other third parties, and we may combine such information with information we already hold.
How we may use information
We may use information for any lawful business purpose, including but not limited to:
- Operating, providing, maintaining, securing, and improving the Services;
- Communicating with you about inquiries, projects, invoices, updates, marketing, newsletters, surveys, events, and other information we believe may be of interest;
- Personalizing content, recommendations, and advertising on our Services and on third-party properties;
- Measuring engagement, conducting analytics and research, training and improving models and tools, and developing new products, features, and offerings;
- Detecting, investigating, and preventing fraud, abuse, security incidents, and other harmful, unauthorized, or illegal activity;
- Establishing, exercising, or defending legal claims and complying with applicable laws, regulations, court orders, and lawful requests from public authorities;
- Any other purpose disclosed to you at the time of collection or otherwise with your consent.
How we may share information
We may share information in the following circumstances and with the following categories of recipients:
- Service providers and vendors that perform functions on our behalf, including hosting, storage, email delivery, customer support, project management, analytics, advertising, payment processing, and similar services.
- Advertising, marketing, and analytics partners for purposes including measurement, attribution, audience building, retargeting, and interest-based advertising.
- Affiliates and related entities for purposes consistent with this policy.
- Business transfers. In connection with, or during negotiations of, any merger, acquisition, financing, reorganization, bankruptcy, sale, or other transfer of some or all of our assets.
- Legal, safety, and compliance. Where we believe in good faith that disclosure is necessary or appropriate to comply with law, respond to lawful requests, enforce our agreements, or protect the rights, property, or safety of Mark Studios, our clients, or others.
- With your consent or at your direction, including any other purpose disclosed at the time of collection.
To the extent any sharing of information constitutes a "sale" or "share" of personal information under applicable law, we will provide the disclosures and choices required by such law.
Analytics and advertising tools we use
- Google Analytics 4. Our pages load Google Analytics, which sets first-party cookies (such as
_ga) and records the pages you view, links and buttons you click, forms you submit, how far you scroll, and your approximate location, so we can measure how the site performs. You can opt out with Google's Analytics opt-out browser add-on. - Meta Pixel and Meta Conversions API. We may use Meta's (Facebook and Instagram) advertising pixel. It sets advertising cookies (such as
_fbpand_fbc) and tells Meta when you view a page, submit a form, click through to our quote tool, or book a call, so we can measure our ads, improve who sees them, and show ads to people who have visited. When you submit a form, our server may also send Meta a one-way hashed (SHA-256) copy of your email address, together with your IP address, browser user agent and those cookie values. When you pay a Mark Studios invoice or payment link through Stripe, we may send Meta a hashed copy of the email address and phone number entered at checkout, with the amount and currency paid. Meta processes this under its own Privacy Policy; you can control the ads you see in Meta's ad preferences and block these cookies in your browser settings. - Visit source. Our site keeps a small record in your browser's local storage of how you first and most recently arrived (the referring site, landing page, campaign tags, and ad click IDs such as
gclidandfbclid) for up to 90 days, and passes it to our quote tool at start.markstudios.com so we know which pages and campaigns bring in projects.
Service providers we use
These providers process information on our behalf when you use the site or work with us:
- Vercel hosts the site and receives standard request data such as your IP address and browser user agent.
- Cloudflare serves our portfolio videos (Cloudflare R2) and runs Turnstile, the spam check on our forms, which evaluates your browser and IP address.
- Resend delivers the email generated when you submit a form on the site.
- Cal.com handles call bookings made through our booking links and embeds.
- Stripe and PayPal process payments; card data never reaches our servers.
- Google Fonts and YouTube serve the site's fonts and the embedded videos on some pages.
Retention
We may retain information for as long as we deem necessary to provide the Services, fulfill the purposes outlined in this policy, comply with our legal, tax, accounting, and regulatory obligations, resolve disputes, and enforce our agreements. Retention periods vary based on the type of information and the context in which it was collected.
Your choices and rights
Depending on your jurisdiction, you may have rights regarding the information we hold about you, which may include the rights to access, correct, delete, port, or restrict certain processing, and to object to certain processing or withdraw consent. To exercise an applicable right, contact contact@markstudios.com. We may need to verify your identity and may decline requests as permitted by law.
Security
We use commercially reasonable measures designed to protect information. No method of transmission or storage is 100% secure, and we cannot guarantee the security of any information.
International transfers
We are based in the United States and may store and process information in the United States or any other country in which we, our affiliates, or our service providers operate. Laws in those countries may differ from those in your jurisdiction.
Third-party content and links
The Services may contain links to, or be embedded in, third-party websites, products, and services that are not owned or controlled by Mark Studios. We are not responsible for the privacy practices or content of any third party.
Children's privacy
The Services are intended for a general audience and are not directed to children under the age of 16. We do not knowingly collect personal information from children under 16.
Changes to this policy
We may update this Privacy Policy at any time. The "Last updated" date above reflects the most recent revision. Your continued use of the Services after any update constitutes your acceptance of the updated policy.
